The agreement that governs your use of The Working — what the practice is, who may use it, and the terms of membership.
The Working (the "Service") is operated by Aura Obscura Limited, a company incorporated in Hong Kong ("we", "us", "the operator"). By accessing or using theworking.app and the practice tool, you agree to these Terms of Use and to our Privacy Policy. If you do not agree, do not use the Service.
The Working is a self-directed ritual instrument combining connected breathwork, bilateral visual tracking, and binaural sound. It is a tool for personal practice used entirely at your own discretion. It does not constitute medical, psychological, or therapeutic treatment, diagnosis, or advice, and it does not replace care from a licensed professional. Always seek the advice of a qualified provider with any questions about a medical or mental-health condition.
You must be at least 18 years old to use the Service. You must not use the practice if any of the contraindications described on our precautions page apply to you, including (without limitation) cardiovascular disease, epilepsy or seizure history, uncontrolled high blood pressure, glaucoma or detached retina, recent surgery or serious injury, pregnancy, asthma (unless cleared by a physician), schizophrenia or active psychosis, bipolar disorder in an acute phase, active suicidal ideation, or being under the influence of alcohol or other substances. By using the practice you confirm that none of the contraindications apply to you.
You are responsible for the accuracy of your account information, for keeping your credentials secure, and for all activity under your account. Notify us promptly of any unauthorised use.
You may cancel at any time from your account dashboard, which opens our payment processor's billing portal. Cancellation stops all future billing and keeps your access until the end of the current paid period. Except where required by law, payments already made are non-refundable, including for partial periods.
If you choose to share a note "as a dispatch," it becomes publicly visible on the community page alongside the first name on your account. Do not submit content that is unlawful, harassing, hateful, infringing, or that discloses others' private information. We may remove content or suspend accounts that violate these terms.
Connected breathwork produces real physiological changes, and the practice may bring up intense physical sensations, emotion, or temporary altered states. By using the Service you acknowledge these risks, accept full responsibility for your use of the instrument and anything that arises from it, and agree to release the operator and its creators from all liability to the fullest extent permitted by applicable law. Practise seated or lying down, never while driving or near anything you could fall against, and stop at any time if something feels like too much.
The Service, including its text, design, code, and audio, is owned by the operator or its licensors and is protected by applicable laws. You may use it for your own personal practice but may not copy, resell, or redistribute it without permission.
The Service is provided "as is" and "as available," without warranties of any kind, whether express or implied, including fitness for a particular purpose and non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or that it will produce any particular result.
To the fullest extent permitted by law, the operator and its creators will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss arising from your use of or inability to use the Service. Where liability cannot be excluded, it is limited to the amount you paid for the Service in the twelve months before the claim.
You agree to indemnify and hold harmless the operator and its creators from claims arising out of your use of the Service or your breach of these terms.
These terms are governed by the laws of the Hong Kong Special Administrative Region, without regard to conflict-of-law principles, and disputes will be handled in the courts of Hong Kong unless otherwise required by law. This choice of law does not remove any mandatory consumer-protection or data-protection rights you have under the laws of the country where you live.
We may update these terms from time to time. The "last updated" date above reflects the current version, and continued use after changes constitutes acceptance.
